As many of you know, on April 24, 2014 the FDA released a 241 page document outlining how the FDA plans on regulating tobacco products including cigars. After the document’s release, the FDA’s 75 day comment period began in which the department is seeking specific input on several of the proposed options as well as comments on the overall proposal. The 75 day comment period is a very important time for the cigar industry and consumers alike as it is our opportunity to get involved and let the FDA know that we, as cigar enthusiasts, feel that cigars should be exempt from the department’s reach!<\/p>\n

In their proposal, the FDA provided two options in regards to premium cigars. The first option puts all premium cigars under the department’s jurisdiction, while option two would exclude premium cigars from FDA regulation, essentially allowing the industry to continue to operate in the same manner as it is today. Under the first option, there could be extreme consequences for cigar connoisseurs including, but not limited to, no longer being able to sample cigars at events, a decline in the amount of limited edition and special release cigars, and FDA mandatory testing of cigars which will result in a decrease in products introduced to the market.<\/p>\n

\"Get<\/a><\/table>\n

While all of this information may seem bleak, there is something we as cigar consumers can do. The deeming document preliminarily defines a premium cigar as meeting eight requirements, each of which the FDA is asking for public comment on regarding whether its definitions would be effective and appropriate. This is the time to let the FDA know just how we feel about their proposed options and definitions of what constitutes a premium cigar.<\/p>\n

The proposed requirements for defining as a \u201cPremium Cigar\u201d are:<\/p>\n

1. Is wrapped in whole tobacco leaf
\n 2. Contains a 100 percent leaf tobacco binder
\n 3. Contains primarily long filler tobacco
\n 4. Is made by combining manually the wrapper, filler, and binder
\n 5. Has no filter, tip, or non-tobacco mouthpiece and is capped by hand
\n 6. Has a retail price (after any discounts or coupons) of no less than $10 per cigar (adjusted, as necessary, every 2 years, effective July 1st, to account for any increases in the price of tobacco products since the last price adjustment)
\n 7. Does not have a characterizing flavor other than tobacco
\n 8. Weighs more than 6 pounds per 1000 units.<\/p>\n

The 75 day comment period is short and we must use all of the time we have left to make sure our opinions are heard. There are also links to other cigar industry resources like Cigar Rights of America (CRA)<\/font><\/a> and the International Premium Cigar & Pipe Retailers Association (IPCPR)<\/font><\/a> legislative action centers. It is important that we all communicate one unified voice to the FDA as the proposed regulations will drastically affect the way we enjoy cigars. <\/p>\n
